Before design work can begin, you must agree on behalf of your school to the terms and conditions of the 2011 DB Drill Design Agreement. This contract governs the terms on which DB Drill will write the drill for your marching band and the amount, method, and due date of payments you will owe to DB Drill.
Please note that as a condition of your acceptance, you acknowledge that this Design Agreement will be the final source on all matters related to your contract with DB Drill and that anything said to you either verbally or electronically cannot supersede this agreement.

DB Drill Design
2011 Design Agreement

I. GENERAL TERMS. Your school has contracted DB Drill Design (aka DB Drill) to design a marching band field show. DB Drill will design your show and provide you will drill charts generated by the Pyware 3D drill design program. Per the drill package info form, DB will provide printed copies of these drill charts as well as any other requested options to your school. These items (collectively known as the “Drill Package”) will be delivered to you by the date selected in the original sign-up request submitted to DB Drill. Any failure by DB Drill to provide the Drill Package by this date will result in penalties assessed as provided in this agreement.
II. DRILL PACKAGE. The completed Drill Package will consist of an informational document, marcher assignment list, drill charts (unbound and bound as requested in the drill package info), student coordinate sheets (if requested), Pyware 3D drill files (if requested), drill animation file, and a finalized invoice. DB Drill will also return all scores and other materials that your school provided to DB Drill to facilitate the design of your field show with the Drill Package.
III. COSTS. DB Drill assesses a prescribed fee for all services provided. For field shows that include less than fifteen (15) drill charts, the cost will be $20 per chart. For field shows that include fifteen (15) or more drill charts, the cost will be $15 per chart. DB Drill will rewrite any drill originally written by DB Drill at no additional cost. DB Drill will also rewrite any drill that was originally written by a designer not associated by DB Drill at a cost of $8 per chart. DB Drill can purchase standard published musical selections from reputable publishers in the United States and include them with the Drill Package. Each musical selection will be assessed a fee of $35.
IV. INVOICE AND PAYMENT. Your school will compensate DB Drill for the design of your field show within thirty (30) calendar days of the date on your finalized invoice provided in the Drill Package. Payment must be in the form of an educational institution check or official bank check made payable to “DB Drill Design”. A Late Fee of $35 will be added to the invoice on the 31st day after the date of the finalized invoice if payment is not postmarked by the due date. This Late Fee will be assessed repeatedly after each additional 30 day period that the full invoice goes unpaid. Late fees will stop once the invoice is paid in full. Any payments returned to DB Drill by the payer institution for any reason will be assessed a Return Item Fee of $20 or the maximum allowed by your state.
V. LATE WORK. If for any reason DB Drill fails to deliver a completed Drill Package to your school by the agreed upon completion date, you will receive a credit of $10 per day on your final invoice. This credit will only apply to a Drill Package that is delivered late due directly to actions by DB Drill. This credit will not apply in cases where DB Drill provided a Drill Package to the shipper in a timely manner and, through no fault of DB Drill, the Drill Package was unable to be delivered on time (carrier delays, no one available to receive the package, etc).
VI. CREDITS AND DISCOUNTS. DB Drill will, at its sole discretion, include credit and discount offers through its website. These may include, but are not limited to, a discount for returning clients, early sign-up discounts, and limited time special offers. Any eligible credit and discount offer will be included as a part of the welcome email sent by DB Drill. If a credit or discount does not appear in this email, it will not be applied on the final invoice.
